Roundtable "Lawmaking in the Field of Criminal Justice: On the Path from War to Peace"

On October 10, 2025, the V. M. Koretsky Institute of State and Law of the NAS of Ukraine hosted a Round Table entitled "Lawmaking in the Sphere of Criminal Justice: On the Path from War to Peace" 

 The Round Table was organized by the Department of Criminal Justice and Criminology Problems of the V. M. Koretsky Institute of State and Law of the NAS of Ukraine. 

The Round Table was attended by scholars, practitioners, in particular, judges of the Cassation Criminal Court of the Supreme Court, members of the High Council of Justice, and young scholars.

The thematic areas of the Round Table were: Conceptual principles of the development of criminal legislation of Ukraine; Conceptual principles of the development of criminal procedural legislation of Ukraine; Conceptual principles of the development of legislation in the field of justice and the judiciary. 

The participants of the event were welcomed by the Director of the V. M. Koretsky Institute of State and Law of the NAS of Ukraine, Doctor of Law, Professor, Vice-President of the National Academy of Sciences of Ukraine, Academician of the National Academy of Sciences of Ukraine Oleksandr Skrypnyuk. In his speech, Oleksandr Vasylyovych noted that the topic of today's Round Table is of great importance for strengthening the capacity of criminal justice and for the sustainability of Ukrainian democracy. First of all, the choice of such a topic was due to the fact that the problem of high-quality lawmaking, including in the field of criminal justice, is a guarantee of effective implementation of law in the form, in particular, of judicial lawmaking, which, as is known, includes ensuring a mechanism for stable and uniform judicial practice in Ukraine.  « I hope that today's event, - emphasized Oleksandr Vasylyovych, - will become a productive platform for finding common answers to complex questions. «Only with cooperation between various authorities and departments can the system create sufficient potential and tools to effectively overcome the enormous challenges facing Ukraine's criminal justice system in times of war», — Olexandr Skrypnyuk concluded.

The first panel discussion was dedicated to Conceptual Principles of the Development of Criminal Legislation of Ukraine, at which Doctor of Law, Professor, Academician of the National Academy of Criminal Justice of Ukraine Olexander Kostenko delivered a report « Problems of interpreting "voluntariness" in criminal law; Doctor of Law, Professor of the Department of Criminal Law and Criminology of the Educational and Scientific Humanitarian Institute of the National Academy of the Security Service of Ukraine Oksana Knyzhenko with a report « Occupation activity as a criminally punishable act under the draft Criminal Code of Ukraine»; Doctor of Law, Professor of the Department of Criminal Law of the National University «Odesa Law Academy», Corresponding Member of the National Academy of Law of Ukraine Vyacheslav Tulyakov with the report «Case Lev v. Ukraine: legal vacuum and obligations of the state». 

During the second panel discussion, dedicated to Conceptual principles of the development of criminal procedural legislation of Ukraine,  the problems of the criminal procedural institute of restoring lost materials of criminal proceedings were discussed (judge of the Cassation Criminal Court of the Supreme Court, Candidate of Law, Associate Professor Sergiy Fomin), digitalization of criminal proceedings (Deputy Chief of Staff of the Supreme Court — Head of the Secretariat of the Cassation Criminal Court within the Supreme Court, Candidate of Law Yuriy Khim’yak), improving the institution of prisoners of war in criminal proceedings (Associate Professor of the Department of Criminal Law Disciplines of the Lviv State University of Internal Affairs, Candidate of Law, Associate Professor Oksana Bronevitska).

The third panel discussion was dedicated to Conceptual principles of the development of legislation in the field of justice and the judiciary, within which the judge of the Grand Chamber of the Supreme Court, Candidate of Law, Lev Kyshakevich delivered a report «War crimes in the practice of the Grand Chamber of the Supreme Court»; Leading Researcher of the Department of Criminal Justice and Criminology of the V. M. Koretsky Institute of State and Law of the NAS of Ukraine, Corresponding Member of the National Academy of Sciences of Ukraine, Doctor of Law, Professor Anatoliy Muzyka with the report «Judicial Lawmaking: A Problem Requiring Legislative Regulation»; Member of the High Council of Justice, Leading Researcher of the Department of Criminal Justice and Criminology of the V. M. Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine,  Doctor of Law, Professor, Oksana Kvasha with a report «Transitional Justice as a Model of Post-War Recovery: Foreign Experience and Prospects for Ukraine».

The Round Table participants took part in the discussion of the reports.

Summing up the results of the Round Table, Olexander Skrypnyuk noted that, By conducting such events as the current one, the V.M. Koretsky Institute of State and Law of the NAS of Ukraine produces valuable scientific ideas that relate to the strengthening and institutional capacity of justice in Ukraine, at least to a small extent making its contribution to this significant achievement.
