Department of Public Administration and Administrative Law
The scientific activity of the Department of Public Administration and Administrative Law Problems of the V. M. Koretsky Institute of State and Law of the NAS of Ukraine began in 1973 after the reorganization at the end of 1972 of the former Department of Public Administration and Economic Problems by forming two separate departments on its basis, In particular, one of them was the Department of Political and Legal Problems of Administration headed by Doctor of Law, Professor, Corresponding Member of the National Academy of Sciences of Ukraine V. V. Tsvetkov. The department formed a fairly large and powerful team of scientists of different generations, who, with their well-known works on organizational and legal problems of public administration in the country, formed a complex of fundamental and applied knowledge, which has received recognition in Ukraine as a leading scientific school of public administration, the founder of which is deservedly considered to be V. V. Tsvetkov.
After the declaration of independence of Ukraine, the Department of Political and Legal Problems of State Administration of the V. M. Koretsky Institute of State and Law of the NAS of Ukraine is one of the leading scientific units in Ukraine in the development of conceptual legal problems of improving state administration and forming a new, «human-centric» administrative-legal doctrine in Ukraine. Since then, the development of research on these problems at the Institute and in Ukraine as a whole has been largely associated with the name of V. B. Averyanov, Doctor of Law, Professor, Academician of the National Academy of Legal Sciences, who headed the department in 1991.
Continuing the traditions of the scientific school of public administration, the department actively participated in the development of problems dedicated to the theoretical aspects of the field of administrative law, issues of reforming the system of executive bodies, democratic principles of the transformation of public administration, fruitful legislative activity — the draft General Concept of Legal Reform in Ukraine (1996); the draft Concept of State Policy on Human Rights (1996); the draft Concept of Administrative Reform in Ukraine (1996—1998); in the preparation of the Constitution of Ukraine of 1996, the draft Law of Ukraine «On the Cabinet of Ministers of Ukraine» (1997—2010); the draft Code of Basic Rules of Conduct for Civil Servants in Ukraine (1997—1999); the Laws of Ukraine “On Civil Service», «On Ministries and Other Central Executive Bodies» (1998—2010), the draft Administrative Procedural Code (1999—2010). It is no coincidence that V. B. Averyanov is rightly considered the founder of the scientific school of administrative law.
In 1999, the department received its current name — Department of Public Administration and Administrative Law.
Since then, the department's scientific research has been devoted to the following topical issues: theory and practice of improving public administration; legal regulation of public administration in the field of economic management; organizational and legal support for the country's scientific and technological development; development of key institutions of administrative law based on the renewal of the national administrative and legal doctrine; deepening of the theoretical and scientific and practical principles of public administration reform, administrative and legal regulation of the civil service and reform of law enforcement agencies; conceptual principles of reforming the institute of administrative responsibility, problems of development of administrative justice in Ukraine. Since October 2010, the department has been headed by Doctor of Law, Professor, Corresponding Member of the National Academy of Legal Sciences of Ukraine, Honored Lawyer of Ukraine, Leading Researcher O. F. Andriyko.Since then, the scientific research of the department's staff has focused on theoretical and applied aspects of the formation of the institution of public administration; administrative and legal regulation of relations between public administration bodies and citizens; development and legal support of public administration institutions, civil service, general administrative procedure; administrative services; organizational and legal support for the management activities of executive bodies in modern conditions; control in the field of executive power; problems of legal support for the activities of public administration bodies in the context of decentralization of executive power; problems of financial and budgetary decentralization, administrative and legal support for the functioning of executive bodies and the budgetary and tax spheres in modern military and post-war conditions in Ukraine.
The participation of the department's representatives in legislative activities was also significant. In particular, the department's scientists participated in the development (at various stages): the Strategy for Reforming Public Administration of Ukraine for 2022—2025, the draft amendments to the Law of Ukraine «On Civil Service»; draft Laws of Ukraine «On Administrative Procedure, On Citizens' Appeals, On Public Consultations, On Amendments to Certain Legislative Acts of Ukraine on Optimization of the Network and Functioning of Administrative Service Centers and Improving Access to Administrative Services Provided in Electronic Form, «On Administrative Fee», «On Mediation», «On Amendments to Certain Legislative Acts of Ukraine Regarding the Enforcement of Court Decisions and Decisions of Other Bodies», «On Democracy through an All-Ukrainian Referendum», «On Amendments to Certain Legislative Acts on the Implementation of Decisions of the European Court of Human Rights», «On Amendments to Certain Laws of Ukraine on Ensuring the Participation of Ukrainian Citizens in the Administration of Justice», «On Amendments to Certain Laws of Ukraine on Ensuring the Right of Citizens to Access State Registration of Civil Status Acts in Connection with the Consolidation of Territorial Communities»; «On Amendments to Certain Legislative Acts of Ukraine on Simplifying Access to Free Legal Aid», «On Amendments to Certain Legislative Acts of Ukraine on the Functioning of Penitentiary and Pre-Trial Institutions during Martial Law»; On Amendments and Recognition of Certain Legislative Acts of Ukraine as Invalid in Connection with the Cancellation of Quarantine Established to Prevent the Spread of Acute Respiratory Disease COVID-19 Caused by the SARS-CoV-2 Coronavirus in the Territory of Ukraine, «On Law-Making Activities», «On Amendments to Certain Laws of Ukraine on Determining the Procedure for Submitting Declarations by Persons Authorized to Perform State or Local Self-Government Functions under Martial Law», «Comprehensive Strategic Plan for Reforming Law Enforcement Agencies as Part of the Security and Defense Sector of Ukraine for 2023—2027», draft Code of Ukraine on Administrative Offensesand others.
Since 2023, the duties of the head of the department have been performed by Doctor of Science in Public Administration, Professor Ya.F. Zhovnirchik. At the present stage, the Department of Public Administration and Administrative Law Problems remains the flagship of public administration, administrative law, and financial law academic research in Ukraine and is a leading scientific unit that ensures the development of scientific topics related to the study of fundamental problems of administrative and legal doctrine, the science of financial and budgetary law, and the science of public administration.
Since 2022, the Department has been offering postgraduate and doctoral studies for the training of: Doctors of Philosophy in the specialty 281 «Public Management and Administration», according to the educational and scientific program «Public Management and Administration»; as well as for the training of Doctors of Sciences (field of knowledge 28 «Public Administration»), specialty 281 «Public Management and Administration».
The Department also continues to train academic staff through postgraduate and doctoral studies in the following specialties: 081 «Law» and 12.00.07 «Administrative law and process; financial law; information law».
